The MedHelpers (“we,” “us,” “our”) provides an independent marketplace for Medicare insurance plan comparisons and enrollment assistance through our website, themedhelpers.com (the “Service”).
PLEASE READ THIS AGREEMENT CAREFULLY. BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS OF USE. IF YOU DO NOT AGREE TO ALL TERMS, DO NOT ACCESS OR USE THE SERVICE .
1. Acceptance of Terms
This Terms of Use Agreement (“Agreement”) constitutes a legally binding agreement between you (“you,” “your”) and The MedHelpers. Your access to and use of the Service, including all Medicare plan comparisons, educational content, and enrollment facilitation services, is conditioned upon your acceptance of and compliance with these terms. We reserve the right to update these terms at any time without notice; the most current version will be posted on our website, and your continued use constitutes acceptance .
2. Medicare-Specific Provisions & Eligibility
2.1. Eligibility
The Service is available only to:
Individuals who are 18 years of age or older and are researching Medicare options.
Medicare-eligible beneficiaries (age 65 or older, disabled, or diagnosed with End-Stage Renal Disease (ESRD)).
Authorized caregivers, legal representatives, or individuals holding a valid Power of Attorney for an eligible beneficiary .
2.2. Plan Information
All data regarding Medicare Advantage (Part C), Prescription Drug (Part D), and Medicare Supplement (Medigap) plans is sourced directly from insurance carriers and their publicly available filings .
All premiums, copayments, formularies (drug lists), and provider networks are subject to change by the insurance carriers and the Centers for Medicare & Medicaid Services (CMS). For example, recent rules have implemented a $2,000 out-of-pocket cap on Part D spending and limited insulin costs to $35/month .
Final enrollment in any plan is contingent upon verification of your valid Medicare Beneficiary Identifier (MBI) and eligibility by the chosen insurance carrier.
3. User Responsibilities
By using the Service, you agree to:
Provide complete, accurate, and truthful information regarding your Medicare status, health, and prescriptions to receive accurate plan matches .
Maintain the confidentiality and security of your account credentials (username and password).
Immediately notify us of any unauthorized use of your account or any other breach of security.
Comply with all applicable laws and CMS rules and guidelines, including those prohibiting fraudulent enrollments .
4. Intellectual Property Rights
All content on themedhelpers.com, including text, graphics, logos, and software, is the property of The MedHelpers or its licensors and is protected by United States and international copyright laws .
“The MedHelpers” name and logo are registered trademarks and may not be used without prior written consent.
You are prohibited from:
Scraping, harvesting, or copying any plan data or content for any commercial use.
Modifying, reverse engineering, or creating derivative works based on our comparison tools or website code.
Redistributing, selling, or licensing any content obtained from the Service. You agree to liquidated damages of up to $100,000 for breach of this provision .
5. Disclaimers and Limitations of Liability
5.1. Service Status Disclaimer
The MedHelpers is an independent, licensed insurance marketplace. We are:
NOT a government agency, Medicare-contracted insurance carrier, or affiliated with the Centers for Medicare & Medicaid Services (CMS) .
NOT a medical provider. The content on this site is for educational and informational purposes only and is not a substitute for professional medical advice .
5.2. No Warranties
THE SERVICE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND. WE EXPRESSLY DISCLAIM ALL GUARANTEES REGARDING THE ACCURACY, COMPLETENESS, OR TIMELINESS OF THE CARRIER-PROVIDED DATA AND PLAN INFORMATION .
5.3. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR MAXIMUM AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THIS AGREEMENT OR YOUR USE OF THE SERVICE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL BE LIMITED TO TEN THOUSAND U.S. DOLLARS ($10,000).
6. Third-Party Services
The Service may contain links to third-party websites or services, such as Medicare.gov or individual insurance carrier sites. We provide these links for your convenience only . We do not control, and are not responsible for:
The content, accuracy, or privacy practices of these third-party sites.
The final plan enrollment processes conducted by carriers.
The adjudication of claims or the administration of benefits by carriers.
Your interactions with any third-party providers accessed through the Service are at your own risk.
7. Dispute Resolution; Arbitration Agreement
7.1. Mandatory Arbitration
Any dispute or claim relating in any way to your use of the service or this agreement shall be resolved by binding, individual arbitration, rather than in court. you expressly waive your right to a jury trial and to participate in a class action lawsuit or class-wide arbitration.
7.2. Governing Law & Process
Arbitration shall be administered by JAMS in accordance with its comprehensive rules and shall be conducted in the State of Connecticut under Connecticut law. The initiating party must first provide the other party with a written notice of the dispute, and the parties agree to negotiate in good faith to resolve it for a period of sixty (60) days before initiating arbitration.
8. CMS Compliance
We strictly adhere to all CMS Medicare Marketing Guidelines. This includes, but is not limited to :
Recording all enrollment-related telephone calls for quality assurance and compliance monitoring.
Maintaining a clear separation between educational content and plan-specific marketing materials.
Providing all required CMS disclosures and communications in a timely and conspicuous manner.
Complying with all applicable rules regarding agent and broker compensation to ensure unbiased recommendations.
9. Termination
We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:
Provision of false Medicare eligibility or enrollment information.
Violation of any CMS marketing rules or guidelines.
Any attempt to initiate a fraudulent enrollment.
10. Privacy
Your privacy is important to us. Our Privacy Policy, which describes how we collect, use, and share your information, is expressly incorporated into this Agreement by reference. By using the Service, you consent to the practices described in our Privacy Policy. This includes sharing your information with licensed insurance agents and carriers in our network to facilitate your plan selection, but we do not sell your data to third-party marketers .
